Theft of Services Litigation Program
Introduction
For clients in service industries, theft of services has become a major source of lost revenue. Theft of service also places an unfair burden on a client’s legitimate customers, who are forced to subsidize the benefits that unauthorized users receive by illegally obtaining services. A valuable tool for our clients in the fight against theft of service is the Wargo & French Theft of Services Litigation Program. This program allows clients who identify unauthorized users of their services to pursue legal remedies against those entities or individuals to protect their legal interests.
When Can the Program Be Used and How does it Work?
The Theft of Services Litigation Program was developed to minimize the amount of time our client’s personnel are required to expend addressing theft of service issues, thereby allowing our clients to focus on business matters, not legal disputes. Once this program is implemented, legal relief can be instituted against entities or individuals who have engaged in theft of service by utilizing the following simple process:
- Legal process is initiated by client with a request to Wargo & French LLP
- Wargo & French LLP sends demand letter to unauthorized user. If unauthorized user refuses to settle
- Upon client approval, Wargo & French LLP files lawsuit against unauthorized user
- Wargo & French LLP pursues the litigation to final judgment
Why Utilize the Theft of Services Litigation Program?
The Theft of Services Litigation Program offers clients who have previously had no legal options a systemic method for responding to theft of their services. The program creates a streamlined litigation system tailored to the needs of the specific client. When an unauthorized user or misappropriator of services is identified by the client, Wargo & French attorneys who are familiar with the client’s business and experienced in litigating theft of service issues can immediately begin pursuing legal proceedings. This program should allow clients to dramatically reduce the number of theft of service incidents they experience.
Because of the unique nature of this service, the firm will consider (and has applied) a number of creative billing arrangements from reduced billing rates to contingency fee arrangements to make the program work for our clients.
