Document Response System

Many businesses are required to respond to numerous non-party subpoenas and document requests. Handling such matters through local offices is an ad hoc practice that leads to inconsistencies and mistakes, particularly when delegated to employees unfamiliar with litigation practices. Even where a company handles such matters in a centralized fashion, the company is required to devote internal resources that otherwise could be reserved for more critical issues. The Wargo & French Document Response System was developed to address non-party requests in an efficient matter. The System centralizes document collection efforts so that all requests for each client are directed to one location. Each request is then promptly and efficiently reviewed and processed with the devotion of the least amount of client resources possible.

Wargo & French Limits the Scope
Before responding to any request, Wargo & French contacts the requesting party to narrow the request. This interaction with the requesting party ensures that the company’s efforts in responding to the request are no greater than necessary to meet the company’s legal obligations.

Nationwide Legal Review
Comprehensive legal review is an integral part of the Wargo & French Document Response System. W&F is familiar with the legal requirements for valid and enforceable subpoenas and document requests in jurisdictions across the country. Accordingly, prior to responding to any subpoena or document request, W&F ensures that such request is valid and enforceable. This process weeds out unenforceable requests, reducing the need to prepare unnecessary responses. Thus, the client is also protected from liability that may otherwise result from responding to an invalid or inappropriate request.

Protection of Information
Legal Review of all documents produced protects your company from the improper disclosure of privileged, confidential or other sensitive information. When appropriate, Wargo & French contacts the requesting party and negotiates an appropriate protective order or other applicable safeguard before providing any response. This is yet another advantage of using the W&F Document Response System over delegation to employees unfamiliar with the litigation process.

Customized Reports
We provide reports to keep clients informed about the status of all document requests. These reports can be customized to include specific information necessary to meet the client’s needs. Reports may include an analysis of pending document requests by jurisdiction, state, region, date requested, name and type of request received.

Capture of Cost
Many companies do not capture any portion of the costs associated with responding to non-party document requests even though most jurisdictions allow recovery of certain costs incurred as a result of the substantial amount of work involved in responding to these requests. In most cases, Wargo & French collects directly from the requesting party an amount that defrays the cost incurred by your company in responding to a request. We typically charge the requesting party a clerical/research fee and a per-page copy recovery charge for this service.
