Representative Matters:
- Represents clients in federal and state (circuit, county and small claims) court actions involving breach of contract, allegations of wrongful foreclosure, slander of title, quiet title and violations of the Racketeer Influenced and Corrupt Organizations Act.
- Provide clients with legal services that include: (1) drafting litigation strategy, recommendations, and possible risk exposures; (2) responding to complaints; (3) drafting and arguing dispositive motions; (4) propounding and responding to discovery, including third-party subpoenas; (5) researching legal issues, (6) conducting and defending depositions; (7) preparing witnesses for trial and depositions, (8) handle mediations; and (9) negotiating settlement.
- Preparing and structuring collateral and security agreements.
- Performing due diligence review of information pertaining to borrowers and guarantors, including corporate governance documents.
- Performing due diligence review in connection with secured transactions, including review of promissory notes, security agreements and UCC financing statements.
- Ongoing representation of bankruptcy trustees and private clients as general counsel in insolvency proceedings, and in the full range of bankruptcy litigation, including avoidance actions.
- Ongoing representation of an international vehicle manufacturer regarding bankruptcy issues.
- Represents a national insurance carrier against actions for breach of contract, petitions for declaratory relief, and fraudulent policy claims. Provided insurance coverage advice concerning property damage, landlord/tenant disputes, construction defect claims, negligent premises maintenance, and automotive accident personal injury claims.
