Representative Matters:

  • Represented a variety of clients with general corporate matters, including preparation and negotiation of a variety of agreements.

  • Defended banks and national financial services organizations in actions by borrowers asserting mortgage-related claims, including allegations of wrongful foreclosure, Real Estate Settlement Procedures Act ("RESPA") violations, Truth-In-Lending Act ("TILA") violations, slander to title, and state mortgage statute violations.

  • Defended a multinational office equipment and supply manufacturer in litigation brought by the manufacturer's utility supplier seeking substantial damages in dispute over provision of natural gas. Obtained summary judgment in favor of manufacturer in the United States District Court for the Northern District of Georgia, which was affirmed by the Eleventh Circuit Court of Appeals.

  • Obtained dismissal with prejudice of all claims on behalf of a national bank where members of automated teller servicing company alleged bank had improperly frozen the company's assets, resulting in bankruptcy of company.

  • Defended a national web hosting company in a breach of contract action pending in state court in Missouri. Successfully obtained dismissal of three of four pending counts of the complaint.

  • Represented a worldwide office equipment corporation as national legal counsel with respect to all bankruptcy matters.

  • Obtained summary judgment on breach of fiduciary obligation claim against former in-house counsel of one of the nation's largest power companies where company learned that attorney had removed, without authorization, privileged and confidential documents.

  • Represented a receiver appointed to marshal the assets of several defendant corporations headquartered in Arkansas and Colorado to satisfy a judgment. Managed numerous outstanding litigation matters in receivership and instructed outside litigation counsel previously retained in those matters on strategy for efficient resolution of those matters. Negotiated with plaintiffs and defendants in receivership action for the entry of a bond to satisfy the judgment and recovered all costs associated with the receivership.

  • Represented a worldwide office equipment corporation in trademark infringement, contributory trademark infringement, and false affiliation dispute in federal court in California. Obtained a preliminary injunction on behalf of client.

  • Represented a bankruptcy trustee in a Chapter 11 proceeding of a Georgia construction company pending in the United States Bankruptcy Court for the Northern District of Georgia. Assisted the trustee in marshalling the assets of the estate. Coordinated and facilitated a multimillion dollar sale of equipment through negotiations with several secured creditors for the benefit of all creditors of the bankruptcy estate.

  • Represented a debtor telecommunications company in bankruptcy proceedings pending in the United States Bankruptcy Court for the Northern District of Georgia. Prepared all pleadings and managed the day-to-day affairs of the debtor in its bankruptcy, including negotiations with secured creditors for continued financing of business operations.
